يستعرض هذا البحث دور عقد الإيجار الإداري كأداة فعّالة لإدارة المرافق العامة، مع التركيز على أبعاده القانونية والفنية والاجتماعية، أظهرت النتائج أن هذا العقد يسهم في تحسين كفاءة استغلال الموارد العامة، وضمان استمرارية الخدمات، ومعالجة المشكلات الاقتصادية والاجتماعية والمالية التي تواجه الدولة، مع الحفاظ على الطبيعة الإدارية للعقد وتحقيق التوازن بين حقوق الإدارة والجهة المستأجرة، كما بين البحث أن الإدارة تمارس رقابة فنية ومالية لضمان الالتزام ببنود العقد وجودة الخدمات، فيما يلعب العقد دوراً اجتماعياً ملموساً من خلال توفير فرص عمل للقطاع غير الحكومي والحد من آثار البيروقراطية والفساد الإداري، وتعكس التوصيات أهمية تعزيز الأطر القانونية والتنظيمية، وترشيد سياسات تسيير المرافق، وتشجيع مشاركة القطاع الخاص بفعالية، لضمان استدامة الخدمات، وتحقيق أعلى استفادة ممكنة من الموارد العامة.

This study examines the role of the administrative lease as an effective tool for managing public facilities, focusing on its legal, technical, and social dimensions. The findings indicate that this contract contributes to improving the efficiency of public resource utilization, ensuring the continuity of services, and addressing the economic, social, and financial challenges faced by the state, while maintaining the administrative nature of the contract and balancing the rights of the administration and the lessee. The study also highlights that the administration exercises technical and financial oversight to ensure compliance with the contract terms and the quality of services. Moreover, the contract plays a tangible social role by providing employment opportunities in the non-governmental sector and mitigating the effects of bureaucracy and administrative corruption. The recommendations emphasize the importance of strengthening legal and regulatory frameworks, rationalizing public facility management policies, and promoting effective participation of the private sector to ensure service sustainability and maximize the benefit from public resources.
